ORDER REGARDING PLAINTIFF'S MOTION FOR ENTRY OF FINAL DEFAULT JUDGMENT

THIS MATTER having come before the Court upon motion by Chanel, Inc., (“Chanel” or “Plaintiff”) Motion for Final Default against the Defendant David XXXXXXXXX d/b/a Perfumekaos.com d/b/a Perfumechaos.com d/b/a Bagsnyc.com ("XXXXXXXXX" or "Defendant") and the Court having considered the moving papers and there being no opposition thereto;

IT IS HEREBY ORDERED that Chanel’s Motion for Final Default Judgment is GRANTED, and judgment is entered in favor of the Plaintiff Chanel, Inc., a New York corporation, with its principal place of business at Nine West 57th Street, New York, New York 10019, and against Defendant XXXXXXXXX, an individual, last known to be residing at XXXX XXXXXXXXX XXXXXX, Apartment #1, Bronx, Bronx County, New York, 14601;

IT IS FURTHER ORDERED AND ADJUDGED:

1. Pursuant to 15 U.S.C. § 1117(c), Chanel is awarded statutory damages against XXXXXXXXX in the amount of $91,837.62, for which let execution issue;

2. Pursuant to 15 U.S.C. § 1117(a), Chanel is awarded attorney's fees against XXXXXXXXX in the amount of $6,700.00, for which let execution issue;

3. Pursuant to 15 U.S.C. § 1117(a) Chanel is awarded investigative fees against XXXXXXXXX in the amount of $592.99, for which let execution issue;

4. Pursuant to 15 U.S.C. § 1117(a) Chanel is awarded costs against Defendant XXXXXXXXX in the amount of $425.00, for which let execution issue;

5. Pursuant to 15 U.S.C. § 1117(d), Defendant XXXXXXXXX is hereby ordered to immediately assign all rights, title and interest in the domain name www.Perfumekaos.com to Chanel;

6. In order to give practical effect to the Permanent Injunction, the domain names Perfumekaos.com, Perfumechaos.com, and Bagsnyc.com are hereby ordered to be immediately transferred by the Defendant, his assignees and/or successors in interest or title, and the Registrar to Chanel’s control. To the extent the current Registrar does not facilitate the transfer of the domain names to Chanel’s control within 30 days of receipt of this judgment, the United States based Registry shall transfer the domain names to a United States based Registrar of Chanel’s choosing, and that Registrar shall transfer the domain names to Chanel; and

7. Interest from the date this action was filed shall accrue at the legal rate.
